Terms of service

1. What you are buying

A Birthday Room is a private web page for one birthday person, hosted by us for one year from the moment you pay. You and the people you share the create link with can fill it with presents: letters, photos and short videos. The birthday person opens it with a separate gift link.

Each room can hold up to 40 presents. Each present can carry up to 5 photos or videos, with a size limit per file. These limits exist to keep hosting affordable and may change for rooms bought after the change.

2. When the year is up

On the day your year ends, the room goes offline and shows a notice instead of the presents. From that day you have a 90-day grace period. During it you can pay to keep the room for another year, and everything comes back exactly as it was.

If the room is not renewed within those 90 days, all of its presents, photos and videos are permanently deleted. We cannot recover them after that. We send a reminder email to the address you bought with about two weeks before the year ends, but email is not guaranteed to arrive, so please keep track of the date yourself. It is shown inside the room.

3. Renewing

Renewing costs a small amount based on how many presents the room holds, shown to you before you pay. It only covers storage and keeping the site running. Renewal is never automatic. We do not store your card and will never charge it without you opening the room and paying again yourself. Each renewal adds one year to whatever time the room has left.

4. Paying

Payment is a one-time charge in US dollars, handled by Stripe. Your card details go to Stripe and never touch our servers. Prices are shown before you pay and may change for future purchases; a change never affects a room you have already bought. You must be at least 18 to buy a room. The birthday person can be any age.

5. The links are the keys

There are no accounts, usernames or passwords. Each room has two links: a create link that lets anyone holding it add, change and delete presents, and a gift link that lets anyone holding it view the room. Treat both like keys to your house:

• Anyone who has a link can use it. We have no way to tell who is holding it, and we cannot revoke a link once it has been shared.
• Share the create link only with people you trust to add presents. Do not post either link publicly.
• If you lose your links, we can email them again to the address you bought with. We cannot send them anywhere else.

We are not responsible for what someone does with a link you or a friend shared with them.

6. Your content and everyone else's

You and the people you invite keep ownership of everything you add to a room. By adding it, you give us permission to store it and show it to anyone who opens the room with a link, which is what the product does. We never use it for anything else.

You are responsible for what you add and for making sure you have the right to add it. Everyone who adds a present through your create link agrees to these terms too, and you agree to only share the create link with people who will respect them. Do not add anything that:

• is illegal, or that you do not have the right to share;
• harasses, threatens or bullies anyone, including the birthday person;
• is sexual content involving anyone under 18, in any form;
• contains malware or is designed to break the site.

We do not look inside rooms. If something is reported to us, we may remove the content or take the whole room down without a refund, and where the law requires it we will report it. We may also take a room down if we are legally required to.

7. Not a backup

Birthday Room is for sharing, not for storage. It is a small service, and things can go wrong: a bug, an outage, a hosting provider problem, or a room being deleted after its year ends. Download anything you want to keep. We are not responsible for lost content.

8. Availability and changes

We do our best to keep the site running, but it is provided "as is" with no guarantee that it will be available at any given moment, free of bugs, or work on every device. We may change how it looks and works at any time.

If we ever have to shut the service down before your year is up, we will email the address you bought with, give you at least 30 days to save your content, and refund the unused part of your year.

9. Limits on our responsibility

To the fullest extent the law allows, Savado Studios and the people who run it are not liable for any indirect, incidental or consequential damages, including lost content, missed birthdays, hurt feelings or lost profits, arising from your use of Birthday Room. Our total liability to you for anything related to a room is limited to the amount you paid us for that room in the twelve months before the claim.

Some places do not allow these limits, so some of them may not apply to you.

10. Your responsibility

If something you or your invitees add to a room causes a legal claim against us, for example because it infringes someone's copyright or defames someone, you agree to cover the costs of that claim.

11. Disputes

If you have a problem, please email us first. Almost everything can be sorted out with a conversation and, if it comes to it, a refund. These terms are governed by the laws of the State of California, United States, and any dispute that cannot be resolved informally will be handled in the courts of that state. Either of us may use small claims court.

12. Changes to these terms

We may update these terms. The date at the top tells you when they last changed. Changes apply to purchases and renewals made after the change; a room you already bought keeps the terms you bought it under, except where a change is needed to comply with the law.

Refunds

If you change your mind within 14 days of buying a room, email us and we will refund you in full, no questions asked. The room will be taken down when we do.

The same goes for a renewal: email within 14 days of paying and we will refund it and put the room back to the expiry date it had before.

If the room does not work for you and we cannot fix it, we will refund you regardless of how long it has been.

Refunds go back to the card you paid with and usually appear within 5 to 10 business days, depending on your bank.

Privacy

What we collect

• Your email address, when you buy a room. We use it to send your links, the receipt, a reminder before your year ends, and to answer you if you write to us. We keep it as a record of the purchase.
• What you add to the room: the birthday person's name, the room's title, and every present with its letter, sender name, photos and videos. This is stored so the room can show it.
• Payment information is collected and stored by Stripe, not by us. We see the amount, the date, the email and the last four digits of the card, which is what Stripe shows on a receipt.
• Server logs. Our hosting provider, Cloudflare, records basic technical information about requests such as IP address, browser type and the page requested, which we use to keep the site running and to investigate problems.
• Usage and error logs. We keep our own record of what happens on the site and inside the room: which pages and features are used, the actions taken (such as opening checkout, adding a present or uploading a photo), and any errors, with the time they happened. When you are signed in with a link or have given us your email, a log entry can be tied to you or to your room, so that if you write to us about a problem we can find exactly what went wrong and fix it. These logs record the action and the error, not the contents of your letters, photos or videos. They are used only to fix problems and improve the service. They are never used for advertising and never shared with anyone. They are deleted after 90 days.

What we do not do

• We do not sell or share your information with anyone for marketing.
• We do not run ads or use advertising trackers.
• We do not look inside rooms unless something is reported to us or the law requires it.
• We do not send you email other than the messages about your room and replies to you.

Who else handles your information

Three companies help us run the service and see only what they need to: Stripe processes payments, Cloudflare hosts the site, stores the rooms and sends our email, and Google Fonts serves the typefaces on this page. Each has its own privacy policy.

How long we keep things

A room's content is kept for one year from purchase plus the 90-day grace period, or longer if renewed. After that it is permanently deleted. Your email address and the record of your purchase are kept for as long as we need them for accounting and tax purposes. Usage and error logs are deleted after 90 days.

Your choices

You can delete any present from inside the room using the create link. If you want the whole room and your email address deleted before its year is up, email us from the address you bought with and we will do it. Note that this cannot be undone.

Children

You must be 18 to buy a room. A birthday person of any age can view a room, and viewing collects nothing beyond the server logs above. We do not knowingly collect personal information from children under 13; if you believe a child has added personal information to a room, email us and we will remove it.
